1. Acceptance
By registering with www.funkyfogeypanel.com or by accessing content that is found on that web site, you are assumed to have read and agreed to the terms and conditions set out here. It may occasionally be necessary to alter the general Terms and Conditions of this site. If this happens you will be notified by email prior to the time at which the alterations become binding. If a member continues to use the FunkyFogey Panel site after being informed of the changes to the general Terms & Conditions this will be taken as confirmation of his/her acceptance of the modified terms.

2. Extent of Service
www.funkyfogeypanel.com offers its registered members the opportunity to take part in online market research surveys. Members receive invitations to take part in individual surveys for which the conditions of participation are separately described. Members are free to choose whether to participate in or to decline each survey.

3. Eligibility to participate
Persons aged 16 and older ( UK ) may become members of FunkyFogey Panel provided they agree to these terms and conditions in their entirety.

4. Security
All members will gain access to the site using their unique username and password. Responsibility for the secrecy of usernames and passwords is solely the duty of the member. If you become aware of unauthorised usage of your FunkyFogey Panel account you must notify FunkyFogey Panel of the incident without delay. FunkyFogey Panel suggests that users change their passwords regularly. We advise members not to write down their password or username, but where they must, to store them separately.

5. Data Protection
Protection of members' personal data is a top priority for FunkyFogey Panel. We aim to provide you with the highest level of online data protection. Before you agree to these Terms and Conditions we suggest you take time to read our Privacy Statement, which will help you understand how your personal information is handled.

6. Conduct of Members
Registered members must agree to take sole responsibility for their conduct when using the www.funkyfogeypanel.com website. FunkyFogey Panel will not tolerate:
The communication of material that is explicit, immoral, dishonest, or of an illegal nature.
The transmission in any form of a programme or file which is capable of interrupting, destroying, or limiting the capabilities of the website, server, connected networks or other users' computers.
The transmission of content for commercial reasons, including any advertising or promotional materials.
Attempts to register more than one account per person.
Attempts to re-register following suspension, except with the agreement of FunkyFogey Panel.
FunkyFogey Panel reserves the right to exclude members who have broken the law or these terms and conditions.

7. Participation in surveys
The number of survey invitations which a particular member receives depends on the user profile they complete. The member has no right to a minimum number of survey invitations.
The member commits him/herself to giving reasonable answers in all surveys, specifically by refraining from giving any obviously nonsensical or unusable answers.

7A. Confidentiality
By becoming a FunkyFogey Panel member, you agree to hold in strict confidence information learned in connection with any survey, project, questionnaire or other market research activity related to FunkyFogey Panel. Members should notify FunkyFogey Panel if they discover any loss or unauthorized disclosure of the information.

8. Termination of Membership
Members may terminate membership of FunkyFogey Panel at any time. After ending his/her membership, the member forfeits their right to a payout or his/her survey incentives. The user should therefore ensure that their final payment is requested before membership is cancelled. Payment of sums corresponding to less than the minimum exchangeable number of points cannot, even in the case of a membership cancellation, be made.
The member must keep their account active by logging in at least once every six months. If a member does not log in or take part in a survey over the course of a six month period despite being sent survey invitations, FunkyFogey Panel will assume this member is no longer active. The member's account balance will, in such cases, be set back to zero.

9. Prize draw information
Information relating to any individual prize draw will be published when that prize draw is active. This will be clearly placed and accessible to all.

9A. Right to incentives
The member will receive an "incentive" or reward for participating in surveys run by FunkyFogey Panel provided that this is stated in the survey invitation. Any incentive may take the form of a sum of money, a payment in kind, the chance to participate in a prize draw or similar. The type of incentive offered will be made clear in the survey invitation.
The member only has a right to receive an incentive if he/she has completed the survey in its entirety. Should the user not belong to the relevant target group, the survey will finish automatically after the first few introductory questions. In this case, the member will not, generally, receive an incentive.
Should the user have made obviously nonsensical or unuseable answers to questions in the survey, the right to an incentive may be forfeited.

9B. Payout of incentives earned
The user may request a payout of the incentive at any time, provided that:
A. He/she has reached the minimum amount specified which is £20
B. He/she is still a member of the FunkyFogey Panel at the time at which the payment is requested
C. The user has the appropriate type of account to receive a monetary payment, in this case a UK bank account.
Payments are by Cheque and take place monthly.

10. Third Party Claims
In agreeing to these terms and conditions you release FunkyFogey Panel from any claims that a third party may make due to a breach of their rights. Defence against claims is taken by FunkyFogey Panel, and any costs that may be incurred will be reimbursed by you.

11. Trademark
FunkyFogey Panel is a registered trademark and its use without permission is strictly prohibited.

12. Copyright
Content published by FunkyFogey Panel is protected under copyright laws. Duplicating any or part of the published materials for commercial purposes requires the prior consent of FunkyFogey Panel. Duplication for personal use is permitted on condition that legends and references are not falsified or deleted. Permission to copy any part of the content may be requested from enquiries@theidfactor.com.

13. Exclusions
www.FunkyFogey.com contains material which is either wholly or partly provided by third parties. FunkyFogey Panel cannot take responsibility for this content. No action may be taken against FunkyFogey Panel because of this content, and you use any content on the website at your own risk.

14. Liability
FunkyFogey Panel tries to ensure that any information provided is up to date and accurate, but we cannot be held responsible for goods offered through third parties. We will amend any inaccuracies or exclusions as soon as is practical once we have been made of aware of them. We will be liable for direct losses of a maximum of £100 , excluding cases of fraud, death, or personal injury caused solely by our negligence. These terms of liability apply only to cases permitted by the law.

15. Law and Jurisdiction
These Terms and conditions are governed by English and Welsh law and are subject to the jurisdiction of the courts.

16. Amendments to the General Terms and Conditions
Should any provision of the Terms and Conditions in whole or in part, be determined to be invalid, unenforceable or void for any reason, these provisions will be deleted and the remainder of the Terms and Conditions shall continue to have full force. The invalid provision shall be replaced by a provision which replicates its legal and commercial meaning as closely as possible.
FunkyFogey Panel reserves the right to amend these terms & conditions at any time and will ensure that all members are aware of changes prior to them being validated. Once a change has been made your continued use of FunkyFogey Panel signals both your acknowledgement of the amendments and your agreement to accept and respect these amended terms.

17. Waiver of rights
At any time if www.funkyfogeypanel.com fails to enforce performance of these Terms and Conditions, this does not constitute a waiver of any of our rights under these terms.
